Rejection of Uninsured and Underinsured Motorist Coverages

In Pennsylvania, the Motor Vehicle Financial Responsibility Law (MVFRL) requires automobile insurance companies to offer customers the option of purchasing Uninsured and Underinsured Motorist Coverage on automobile insurance policies. 75 Pa.C.S.A section 1731. Uninsured Motorist coverage is designed to protect  policyholders in the event they are injured in an accident with an uninsured or even unidentified driver. Underinsured Motorist coverage provides protection in the event a policyholder is involved in an accident with a vehicle that does not carry enough auto insurance. The law, however, does not mandate that such coverages be purchased by a policyholder. Each policyholder has the option of rejecting these important coverages in favor of a lower premium.

In the event a policyholder rejects Uninsured or Underinsured Motorist coverages, the MVFRL imposes strict requirements to document that the policyholder has "knowingly and voluntarily" rejected this valuable protection. 75 Pa.C.S.A Section 1731 provides a rejection form with specific and unambiguous language that must be provided to policyholder by the insurance carrier for signature.
